Agreement to Terms
By downloading, installing, or using Buildermark, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the software.
License Grant
Open Source Software
Buildermark is open-source software released under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the conditions of the MIT License included with the source code.
Team Server
Buildermark Team Server is a separate, paid product offered under its own license terms. Use of Team Server is subject to the specific license agreement provided at the time of purchase or enrollment.
Your Data
Buildermark runs locally on your machine. Your conversation history, git data, and AI authorship metrics remain on your device. We do not collect, transmit, or store your project data. You are solely responsible for the data you import and analyze with Buildermark.
Acceptable Use
You agree not to:
- Use Buildermark in violation of any applicable laws
- Misrepresent AI authorship data generated by Buildermark in a way that is fraudulent or deceptive
- Use the Buildermark name, logo, or branding in a way that implies official endorsement without permission
Intellectual Property
The Buildermark name, logo, and branding are owned by Gelatinous Development Studio and are protected by trademark and other intellectual property laws. The open-source license applies to the software code, not to our trademarks or branding.
Disclaimer of Warranties
Buildermark is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the software will be error-free, secure, or available at all times. AI authorship measurements are estimates and should not be treated as exact figures.
Limitation of Liability
To the maximum extent permitted by law, Gelatinous Development Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Buildermark.
Indemnification
You agree to indemnify and hold harmless Gelatinous Development Studio from any claims, damages, or expenses arising from your use of Buildermark or violation of these terms.
Updates and Modifications
We may update Buildermark and these Terms of Service from time to time. Continued use of the software after changes constitutes acceptance of the new terms.
Termination
We may terminate or suspend access to paid services such as Team Server immediately, without prior notice, if you breach these Terms of Service. The open-source license for Buildermark itself is governed by the MIT License and cannot be revoked.
Governing Law
These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
